Terms of Service

Welcome to Rainbow Bridges ("we," "our," or "us"). By accessing or using rainbowbridges.pet (the "Service"), you agree to be bound by these Terms of Service. Please read them carefully before creating an account or memorial.
1. Acceptance of Terms
By registering for an account or using any feature of the Service, you confirm that you are at least 13 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, please do not use the Service.
2. Description of Service
Rainbow Bridges is a cloud-based memorial platform that allows users to create and share digital memorial gardens for beloved pets. Features include tombstone customization, photo uploads, tribute messages, and decorations. The Service is provided for personal, non-commercial use only.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use at our contact page.
4. User Content
You retain ownership of all content you submit, including photos, memorial text, and tributes ("User Content"). By uploading User Content, you grant Rainbow Bridges a non-exclusive, worldwide, royalty-free license to store, display, and transmit that content solely for the purpose of operating the Service. You represent that you own or have the necessary rights to all User Content you upload, and that such content does not violate any third-party rights or applicable law.
5. Prohibited Conduct
You agree not to: (a) upload content that is unlawful, defamatory, harassing, or infringing; (b) use the Service for any commercial purpose without prior written consent; (c) attempt to gain unauthorized access to other users' gardens or our systems; (d) use automated tools to scrape or collect data from the Service; or (e) impersonate any person or entity.
6. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Memorial Gardens and Privacy Settings
Gardens may be set to public or private. Public gardens are listed and discoverable by anyone on Rainbow Bridges. Private gardens are unlisted and excluded from public listings and search, but remain viewable by anyone who has the garden's shareable link. You are responsible for choosing who you share that link with.
8. Intellectual Property
All design, graphics, software, and other materials provided by Rainbow Bridges (excluding User Content) are owned by or licensed to us and protected by applicable intellectual property laws. You may not copy, modify, or distribute them without our written permission.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NOT BE LOST.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAINBOW BRIDGES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Account Deletion and Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, us, or third parties. You may request account deletion through Settings or by contacting us. We may verify the request and apply a 72-hour security hold before processing. We aim to complete eligible deletion requests within one calendar month after deletion processing begins. Your gardens, tributes, and associated account data will be deleted or de-identified, except for limited records that we must or may retain for billing, security, legal, compliance, processor, or protected-backup purposes.
12. Changes to Terms
We may update these Terms from time to time. We will post the updated version and update the "Last updated" date. For material changes, we will notify registered users by email or in-app notice when the changes take effect. Where applicable law requires advance notice or consent, we will provide it before the change takes effect. Continued use of the Service after an updated version takes effect constitutes acceptance to the extent permitted by applicable law.
13. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in California.
